Terms of Service

These Terms of Service ("Terms") govern your use of Dear Thoughts ("the Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Dear Thoughts is a journaling application that offers writing tools, optional AI-powered reflections, and somatic check-ins through the Foundation module. It is provided for personal, non-commercial use.

2. Not medical or psychological care

The Service is a wellness companion, not a clinical tool.It does not diagnose, treat, cure, or prevent any medical or psychological condition. The Foundation check-in, AI reflections, and all related features are for informational and self-reflection purposes only.

If you are in crisis or experiencing a mental health emergency, please contact local emergency services or a crisis hotline immediately. Do not rely on this Service for urgent care.

3. Account

You must be at least 13 years old (16 in the EU) to create an account. You are responsible for maintaining the confidentiality of your account credentials and biometric lock, and for all activity that occurs under your account.

4. Your content

You retain all rights to the content you create in Dear Thoughts — your journal entries, voice notes, and reflections. You grant us only the limited rights needed to operate the Service: to store the encrypted content on our servers, sync it to your devices, and process your opt-in AI requests.

5. Acceptable use

You agree not to:

• Use the Service for any illegal purpose or in violation of any law
• Reverse engineer, decompile, or attempt to extract the source code
• Use automated tools to scrape data from the Service
• Interfere with the security or integrity of the Service
• Use the Service to harass, abuse, or harm another person
• Impersonate another person or misrepresent your identity

6. AI features

AI reflections are generated by language models and may be inaccurate, incomplete, or inappropriate for your specific situation. They are provided as gentle suggestions only. You are responsible for evaluating their relevance to your life and well-being.

AI features are always opt-in. They do not run unless you explicitly invoke them.

7. Pricing

The Service is currently free. If we introduce paid features in the future, we will notify you at least 30 days in advance and ensure that your existing content remains accessible.

8. Termination

You may delete your account at any time from within the app. We may suspend or terminate your account if you violate these Terms, with notice where possible. On termination, your data is removed per the retention schedule in the Privacy Policy.

9. Disclaimers

The Service is provided "as is" and "as available", without warranty of any kind. We do not guarantee uninterrupted service, that the Service will be error-free, or that any AI reflection will be accurate or beneficial.

10. Limitation of liability

To the maximum extent permitted by law, Dear Thoughts is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.

Nothing in these Terms limits liability that cannot be limited under applicable law — including, in the EU, liability for gross negligence or intentional harm.

11. Changes to these Terms

We may update these Terms occasionally. Material changes will be announced in the app and by email at least 30 days in advance. Your continued use after the change indicates acceptance.

12. Governing law

These Terms are governed by the laws of Romania, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of the courts in Romania, except where mandatory consumer protection law in your jurisdiction provides otherwise.
